General Terms and Conditions (GTC / Terms of Service)


 

1. Scope


1.1 These General Terms and Conditions (GTC) apply to all contractual relationships between the Podology School Podokundig, Gothaer Str. 18, 40880 Ratingen, Germany, Phone: +49 211 428881, Email: (hereinafter referred to as “Podokundig”) and the participants (hereinafter referred to as “Students”), as well as to all other business relationships with third parties relating to the services and courses offered.


1.2 Deviating or additional conditions of the Student shall not apply unless they have been expressly confirmed in writing by Podokundig.


2. Conclusion of Contract and Registration


2.1 Registration for a course is made in writing, by email, or online via the Podokundig website. By registering, the Student submits a binding offer to conclude a training contract.

2.2 Acceptance of the contract offer is made through written confirmation by Podokundig.

2.3 The number of participants in the courses is limited. Registrations are considered in the order they are received.

2.4 By registering, the Student acknowledges these GTC as binding.


3. Services and Course Structure


3.1 Podokundig offers theoretical and practical training in podology. The exact content, schedule, and duration are specified in the respective course descriptions.

3.2 Lessons take place either in Podokundig’s premises or in external practices as part of the practical training.

3.3 Changes to the schedule or course content are reserved, provided they do not significantly alter the overall character of the training.

3.4 If classes cannot take place for important reasons (e.g., force majeure, illness of instructors), a substitute date will be offered whenever possible.


4. Participation Requirements


4.1 Participation in the courses generally requires a school leaving certificate. Additional specific entry requirements are stated in the respective course information or on the Podokundig website.

4.2 Students are obliged to inform Podokundig of any health limitations or relevant pre-existing conditions that could affect their training before the course begins.

4.3 Regular attendance is mandatory. Absences may require make-up sessions in order to be admitted to the final examination.


5. Fees and Payment Terms


5.1 Course fees are specified in the current course information and become binding upon conclusion of the contract.

5.2 Fees are payable in a single agreed-upon installment or in monthly installments. Exact payment terms are specified in the individual training contract.

5.3 If a Student is in default of payment, Podokundig reserves the right to charge reminder fees and exclude the Student from participating in classes until outstanding amounts are settled.

5.4 Refunds of already paid fees are only made within the framework of legal regulations or by individual agreement in exceptional cases.


6. Withdrawal and Termination

6.1 The Student may withdraw from the contract within 14 days of conclusion without providing reasons. The withdrawal must be made in writing.

6.2 After the 14-day withdrawal period has expired, termination of the contract is only possible in compliance with the contractually agreed notice periods.

6.3 Podokundig may terminate the contract without notice if the Student breaches essential contractual obligations (e.g., repeated refusal to pay fees, serious violations of the school rules).


7. Liability

7.1 Podokundig is only liable for damages caused by intent or gross negligence. For simple negligence, Podokundig is only liable in case of violation of a material contractual obligation, with liability limited to foreseeable, typical damages.

7.2 Liability for personal belongings of the Students as well as for accidents on the way to or from the premises is excluded.

7.3 The Student is liable for any damages caused culpably to Podokundig’s facilities or during external practical placements.


8. Data Protection

8.1 Podokundig collects, processes, and stores personal data of Students solely for the fulfillment of contractual obligations and in accordance with the General Data Protection Regulation (GDPR).

8.2 Data is only shared with third parties if necessary for the execution of the course (e.g., with external internship partners) or if legally required.

8.3 Students have the right to access their stored data and request correction or deletion.


9. Copyright and Usage Right


9.1 All teaching materials provided by Podokundig are protected by copyright.

9.2 Reproduction, distribution, or sharing with third parties without explicit consent is prohibited.


10. Final Provisions

10.1 Should individual provisions of these GTC be invalid or unenforceable, the validity of the remaining provisions remains unaffected.

10.2 Amendments or additions to these GTC must be made in writing.

10.3 German law applies. The place of jurisdiction for all disputes is Ratingen, provided the Student is a merchant, legal entity under public law, or a special public fund.
